When you need an immigration lawyer

Most standard visa applications and NIE procedures can be handled by a gestor (administrative consultant) or with professional guidance. But some situations genuinely require a qualified abogado de extranjeria (immigration lawyer). These include: visa refusals and appeals, inadmissibility notices, deportation orders, complex family reunification cases, citizenship applications, and situations involving criminal records or previous immigration violations.

Our lawyer network

ValenciaMove works with a curated network of immigration lawyers in Valencia who specialise in expat cases. These are not generalist law firms - they handle immigration law exclusively, speak English fluently, have direct relationships with the Extranjeria and consulates, and have strong track records with the most common expat visa types, especially the Digital Nomad Visa and the Non-Lucrative Visa. One thing worth knowing up front: the Golden Visa investment route was abolished in April 2025, so property purchase no longer buys residency - if an adviser still pitches it, that is a red flag.

What immigration lawyers handle

  • Visa application preparation and submission when legal complexity warrants full legal representation
  • Visa refusal appeals (recurso de alzada and recurso contencioso-administrativo)
  • Residency renewal complications
  • Inadmissibility and deportation defense
  • Family reunification for complex family structures
  • Long-term residency and Spanish nationality applications
  • Work permit applications beyond standard visa categories
  • Cases involving prior criminal records or immigration violations

The visa landscape in 2026

Most people only need a lawyer once they know which visa they are aiming for. Here are the headline numbers for 2026, so you can see where you stand before booking anyone. Income thresholds are pegged to the SMI (minimum wage, 1,221 EUR per month in 2026) and the IPREM (600 EUR per month).

Digital Nomad Visa (DNV)

Non-Lucrative Visa (NLV)

2,400 EUR per month, plus 600 EUR per month for each dependent

Student Visa

Proof of enrolment plus around 600 EUR per month

Valid for the duration of studies. Allows work of up to 30 hours per week.

The property-investment residency route is closed. No new applications are accepted.

Gestor vs lawyer - which do you need?

A gestor administrativo can handle standard NIE applications, Padron registration, straightforward visa applications, and most routine admin tasks. For legal disputes, appeals, court proceedings, or complex legal situations, you need a qualified abogado. We assess your situation and recommend the appropriate professional level - we do not escalate to lawyers when a gestor will do.

How we connect you

Tell us about your situation in a free consultation. We will assess whether you need a gestor, a lawyer, or both, and make a specific introduction to the right professional for your case. Our referrals come with a warm handover and context - the lawyer already knows your situation before you meet them.
